The investigation began after the Paris prosecutor's cybercrime unit raided X's French office in February. Authorities set the April 20 summons date at that time. The prosecutor's office did not mention Musk by name but noted that the absence of those summoned would not stop the inquiry. Although attendance was mandatory, French authorities could not compel Musk to appear at this stage.

Prosecutors allege that X's algorithms distorted content treatment, improperly extracted user data, and violated rights through sexually explicit deepfakes. The investigation has expanded in recent months to include these serious allegations. X, formerly known as Twitter, has faced increased scrutiny from regulators and governments since Musk's 2023 takeover. Issues under examination include content moderation, data practices, and compliance with local laws.

International Tensions and Responses

The case has added to tensions between the US and Europe regarding Big Tech and free speech. The Wall Street Journal reported that the US Justice Department sent a letter to the Paris prosecutor, stating it would not cooperate with the probe, viewing it as politically motivated. The Paris prosecutor said it had no knowledge of such a letter and emphasized the independence of the French judiciary.

Musk previously denied the accusations in July, calling the investigation politically motivated. Prosecutors had summoned Musk for a voluntary interview, which does not allow authorities to use force. If a person fails to respond, prosecutors may consider police custody. Criminal defence lawyer Julia Bombardier noted that justifying a refusal to appear can help avoid perceptions of obstructing the investigation. She suggested that representatives could be interviewed instead.

Other X executives, including former CEO Linda Yaccarino, have also been summoned as witnesses. The French cybercrime unit previously arrested Telegram founder Pavel Durov in 2024 on charges related to organized crime on the messaging app. Durov called the charges "absurd" and criticized France for using investigations to suppress free speech and privacy. US President Donald Trump has also accused Europe of unfair treatment of US tech companies through regulation and fines.
