Microsoft’s involvement in OpenAI came under direct scrutiny during the trial of Elon Musk’s lawsuit against Sam Altman. The court examined Microsoft’s role during the brief period in 2023 when Altman was ousted from OpenAI, a time referred to as “the blip.” Mira Murati, who served as CEO during Altman’s absence, provided key testimony about both Microsoft’s position and Altman’s leadership at OpenAI.
In a video deposition, Mira Murati stated that Sam Altman was not always transparent with her while they worked together at OpenAI. She said Altman sometimes withheld important information and was not fully open or honest about company matters. Murati also claimed that Altman undermined her role as CTO in 2023, creating internal competition and tension among senior leaders instead of promoting collaboration.
When asked if Altman was consistently truthful and candid, Murati replied, “Not always.” She described his communication and leadership as inconsistent, which she said led to confusion and mistrust within the company. Murati explained, “My concern was about Sam saying one thing to one person and completely opposite to another person. And this made it a very difficult unpredictable environment to work with.” She added that the management situation was “completely messed” and that she faced significant challenges leading in such a complex organization.
Murati’s testimony indicated that Microsoft maintained a neutral public stance during Altman’s ouster and did not pressure OpenAI’s board. She revealed that Microsoft received an exclusivity period of about 6 to 12 months, allowing it to use and integrate OpenAI’s technology before it became widely available. This arrangement gave Microsoft a commercial advantage over competitors, enabling it to develop products and attract customers ahead of others.
Murati stated, “As part of the commercial agreement so that they could have a benefit of getting a head start on commercializing.” She also confirmed that Microsoft continued to support OpenAI during the leadership crisis and Altman’s eventual return as CEO. During “the blip,” OpenAI employees independently organized a petition demanding Altman’s reinstatement. Murati clarified that Microsoft did not influence or organize this action.
When asked if Microsoft was supportive of OpenAI during Altman’s firing and rehiring, Murati responded, “I hope so. Yes.”
Shivon Zilis, an advisor at OpenAI and a close associate of Elon Musk, also testified. She described her advisory role at OpenAI since 2016 and discussed her personal relationship with Musk, which began in late 2020 or early 2021. Zilis said she acted as a bridge between key parties at OpenAI to maintain cooperation and reduce misunderstandings.
Zilis testified that OpenAI’s board was very concerned when ChatGPT launched without sufficient prior communication. She also opposed a proposed investment in Helion Energy, citing risks in unproven technology. Zilis recalled that Musk once suggested OpenAI could become part of Tesla to address financial challenges and slow the development of artificial general intelligence for safety reasons.
