The Australian Competition and Consumer Commission (ACCC) has initiated legal action against Amazon Australia in the Federal Court. The regulator alleges that Amazon included unfair terms in its Prime subscription contracts, allowing the company to make significant changes to its streaming service without providing compensation to subscribers.
The ACCC claims that more than one million annual Prime subscribers were affected by these contract terms between November 2023 and August 2025. According to ACCC Chair Gina Cass-Gottlieb, Amazon Australia relied on several unfair terms to introduce advertisements to Amazon Prime Video. The regulator asserts that the lawsuit addresses not only the introduction of ads but also broader contract issues.
The ACCC alleges that Amazon included five specific unfair terms in its contracts. These terms permitted Amazon to make major changes to Prime services, including Prime Video, without offering refunds or meaningful compensation to subscribers. The contracts containing these terms were signed by over one million Australian customers between 1 November 2023 and 18 August 2025.
The legal action also names Amazon.com Services LLC, which the ACCC claims helped draft the Australian subscription contracts and knowingly participated in the conduct under investigation.
The ACCC is seeking several remedies through the court. These include declarations that the contract terms were unfair, financial penalties, consumer redress, legal costs, and other orders against Amazon. The case highlights the regulator’s focus on ensuring fair treatment for Australian consumers in digital subscription services.
In response to the lawsuit, an Amazon Australia spokesperson stated that the company is reviewing the ACCC's case in detail. The spokesperson also noted that Amazon has cooperated with the regulator throughout the investigation.
The ACCC’s legal action comes as digital subscription services face increasing scrutiny over contract fairness and consumer rights. The outcome of this case could influence how streaming platforms structure their subscription agreements in Australia. It may also set a precedent for similar cases involving other digital service providers.
The ACCC’s move underscores its commitment to protecting consumers from unfair contract terms, particularly in the fast-growing digital entertainment sector. The case will proceed in the Federal Court, with outcomes to be determined as the legal process unfolds.
